A free society laws must be subject to change.
The rule of law is perceived by many as an absolute requirement for people to prosper economically and enjoy freedom. The laws are usually made by bureaucratic agencies or members of national assemblies. When formulating the laws, law makers take into account many perspectives. The law constitutes of political system most of them guaranteeing people their simple human rights.
In the United States of America the Bill of Rights assures its citizens their ordinary human rights should never be question to change. The bill of Right ensures that people of different diversity coexist harmoniously. Laws that make up groundwork of a free society should be firm. This can only be achieved only if they address the wants of the society. Every society has varied wants of the society citizens contain different groups of persons therefore the law should be able to cater for each and every person’s needs. When defining the suitability of a law its effect to the society must be gauged. Care should also be considered to ensure that altering the law in order to profit portions of the community does not happen at the expense of another constituent. For instance in US certain sections of the society have been taken as second class citizens. Years ago it was okay for blacks not to have equal rights. Hanging criminal’s sentenced to death row was also accepted by the society. In today’s world people are against hanging of criminals.
People are challenging the law for being old fashion instead of instead for being in line with public view and sentiments. Constitutionalists believe that certain laws should not be focus to change in a free society. They believe for strict reading of the constitution since they honor the forefathers who were behind the drafting of the constitution. They encourage the lawmakers to honor the constitution since it has successfully being used by different generations. In order to change anything in it, constitutionalists advocate for a vigorous process to achieve this. For example in the United State of America there are number of mechanisms such as direct democracy in order to make any change.
So as to ensure the government is always accountable to its citizens, a system of checks and balance should be introduced to guarantee that the laws are not changed. If the law is to work for a free society it must make an ethical response to changing details in the general public. An acceptable jurisprudence must determine the equality and reasonableness of principles, rules and principles compromising the normative social organization of the law.
