The Kansas man who was forced to pay child support as a sperm donor
You may be thinking that the law is just funky with the laws in Kansas, but that isn’t necessarily the case. I read about the man who donated his sperm to a couple on Craig’s list. His deed was with good intentions. If I were a man looking to make some extra cash and make people who couldn’t conceive a child together happy, I would do it. What this man, unfortunately, didn’t realize is that he did it on a more personal level rather than on a professional level. When I read the headline that a man who donated his sperm was ordered to pay child support, I didn’t believe it. I had to read it for myself. A few reasons were swirling through my head: The couple couldn’t support the child on their own, or, the donation wasn’t done under legal or professional terms.
Sperm donation wasn’t legally done
Once I figured out that the guy was responding to a Craig’s list ad, I understood why he was court ordered to pay child support. Any conception done during “intimacy” is the responsibility of the two people who conceived the child. Though it wasn’t exactly an intimate act, it wasn’t the professional or legal act it should have been, it was done on a personal level. Even though the sperm donor or “father” waived his rights through the entire process, the district attorney in the city of Topeka, determined that he could not have legally done that without going through a professional in a sperm bank.
Why the sperm donor has to pay child support
It wasn’t just because of the fact that it wasn’t done under legal or professional terms. The father is ordered to pay child support based on the fact that the family is on welfare. While there is nothing wrong with being on welfare, if two people plan on having a child under such circumstances they need to be better prepared for the finances that follow. Since the father is partly responsible for the act that is deemed as illegal or unprofessional, he is now responsible for supporting the child. I agree with this notion, because if they had gone to a sperm bank, they may have discovered that they cannot afford to create or have a child because of the expenses that come with just the conception.
Why I agree with the sperm donor paying child support
Even though you may see the headline, “sperm donor ordered to pay child support” and think to yourself: what is this world coming to? Don’t lose faith in the world. They did the sperm donation illegally. The reason why it needs to be done under the care of a professional is because anybody could walk into the welfare office saying it was a sperm donation. If it is done professionally there will be documentation of it. This ensures that all those responsible for caring for the child are involved and can’t just simply say that they donated their sperm. While it may seem unfair under this circumstance, just think of how many guys would take advantage of saying it was a donation to get out of paying child support.
